• Tenders are invited for Providing Legal Services for Expected Arbitration Case/ Litigation ANNOUNCEMENT DATE: 20 /5/2021 CLOSING DATE: 27 /5/2021 Terms and Conditions:  Quotation must be addressed to the Chairman of the Internal Tender Committee (ITC), BidBid, marked with the RFQ No., the description and the closing date.  Valid commercial & municipality registrations shall be attached with original offer.  Your quotation must be valid for (90) days from the quotation date.  The quotation must be duly signed and stamped from the bidder authorized person.  If the total quotation amount above (R.O. 20,000) The bidder shall enclose a bank guarantee issued by any bank in the Sultanate of Oman for value of (R.O 1,500) from the total quotation value and addressed to the chairperson of the (ITC), Mazoon Electricity Company. Any offer value above R.O. 20,000 not includes (R.O 1,500) bid bond will be rejected.  If the total quotation amount above (R.O. 20,000) The awarded bidder shall enclose (5% performance bond) a bank guarantee issued by any bank in the Sultanate of Oman for value of (5%) from the total quotation value and addressed to the chairperson of the (ITC), Mazoon Electricity Company  Omani ports must be used to import goods and commodities in connection to this RFQ  The bidder shall comply with MZEC HSE requirements for bidders, as well as, with MZEC Electricity Safety Rules. scope of work. The firm shall preform and represent the company in an arbitration / litigation . The firm should be a specialist in construction contract . The main Scope of Work of the Legal Firm in this kind of service shall be including but not limited to the following; A. Study the case file and provide the technical/legal advice and procedures related to it, as well as clarify the laws that apply to the subject matter of the lawsuit. B. Support the company to do settlement if applicable. C. Clarify the company's position in the issue in dispute, advise the company in the event of counter-claims, and take the necessary actions towards filing a subsidiary lawsuit. D. Develop project plan with timeline and highlight the risks and how the firm will manage them. E. Preparing a draft of the arbitration terms, and ensuring that they fulfill the legal requirements and achieve them in the interest of the company. F. Attending before the arbitration / litigation panel and discuss the terms to ensure that all the conditions contained are in compliance with the laws, before signing it. G. Representing the company before and during the panel and attending all of the sessions, and to ensure that all the procedures that have been taken have come in accordance with the laws. H. Drafting and preparing all legal notes, replies and memos and to review it with company before submit to the panel. I. Representing the company before all the expert bodies that may be appointed in the lawsuit, and ensuring their compliance with the appointment provisions. J. Ensure the availability of all documents and notes that support the company's position through constant communication with the company's staff. K. Support the company to identify, review and evaluate all required / important documents L. Review all documents and notes obtained from the company to ensure that they reflect the real position of the company and support it in the case. M. Translation all documents needed such as but not limited to contracts, documents etc., written in foreign language, and to review all translated documents in order to ensure that it has been translated correctly and that it reflects the true meaning of the translated documents. N. Ensure that all responses and documents are delivered to the panel/experts on the scheduled dates. Page 4 11 O. Attending all meetings with the expert bodies and discussing with them the documents and notes submitted to ensure that they are informed and knowledgeable about all aspects of the case. P. Review all of the reports submitted by the expert bodies, and to discuss with them the same, to ensure that all the reports have been prepared in accordance with the correct legal and accounting principles, and that they contain all the defenses and documents that have been submitted to them and that they reflect the true and correct situation of the case. Q. Review the panel judgments and make sure that they were issued in accordance with the legally determined. R. Follow up on the implementation of judgments and provide immediate advice to the company on the steps to be taken following the issuance of judgments. S. The firm will be responsible to recover all fees, charges and expression that have been paid in the case in accordance with the judgments issued. T. Appeal to court if necessary / required. U.
